The 2025 DoD policy directing that service members serve in their birth sex remains formally in effect, but enforcement has been uneven due to multiple federal injunctions. As of late April 2026, three circuit courts have issued competing rulings, and the Supreme Court has been asked to consolidate. For currently-serving members: commands have received guidance to pause adverse personnel actions pending judicial resolution. If you are directly affected, your unit legal office (JAG) can brief you on the current stay status in your jurisdiction.
